ICAN has filed a Citizen Petition with the FDA calling on the agency to reverse its reckless course on Covid-19 injections for teenagers. The Petition demands that the FDA revoke its emergency use authorization (EUA) for Pfizer’s product in children aged 12 through 15 and deny Moderna any future EUA for children aged 12 through 17.
The document, submitted through ICAN’s legal team, spans 20 pages, cites dozens of medical studies, and includes 94 footnotes and roughly 1,500 pages of sources, but it boils down to a few simple principles: There never was any emergency with this age group in the first place, rendering EUAs illegal under federal law; the clinical trials relied upon to authorize the vaccines were woefully deficient; almost all in the 12-15 age demographic currently have natural immunity to Covid-19; and the injury risks from injection are catastrophically higher than any purported benefit.
The Petition cites a Lancet article of March 2021 that found Covid’s death toll among children was a negligible 0.17 per 100,000 population. Federal judge blocks vaccine mandate for federal workers in Kentucky, Ohio and Tennessee
Separately, a U.S. district judge in Kentucky on Tuesday issued a preliminary injunction blocking the Biden administration from enforcing a COVID vaccine mandate for federal contractors and subcontractors in three states — the first of at least 13 legal challenges nationwide against the mandate.
The ruling applies in Kentucky, Ohio and Tennessee, which joined in a lawsuit against the Biden administration arguing the mandate for companies that do business with the U.S. government violated the U.S. Constitution, Bloomberg reported.
According to U.S. District Court Judge Gregory Van Tatenhove of the Eastern District of Kentucky, Biden, in all likelihood, can’t use congressionally delegated authority to manage the federal procurement of goods and services to impose vaccines.
Kentucky, Ohio and Tennessee have about $9 billion, $10 billion and $12 billion, respectively, in government contracts. Contractors who refuse to comply risk being blacklisted by the government, Van Tatenhove said, citing Biden’s remarks from Sept. 7: “If you want to work with the federal government, vaccinate your workforce.”
Van Tatenhove said the federal government’s mandate amounts to an overreach of contracts, and the statute could be used to enact virtually any measure at the president’s whim under the guise of economy and efficiency.

Nov 25, 2021. Missouri court finds all state COVID measures both unconstitutional and illegal! Missouri citizens have a lot to be thankful for today. In a remarkable, strongly-worded opinion, the Cole County Circuit Court of Missouri just ended ALL the state’s Covid measures. In Shannon v. Missouri Department of Health, the Court found that the Department of Health’s regulations CANNOT “abolish representative government in the creation of public health laws,” and CANNOT “authorize closure of a school or assembly based on the unfettered opinion of an unelected official.” While we’ve seen other favorable court decisions lately, this one is a true breakthrough. It moves the bar. The Court didn’t just find a technical reason to set aside the DOH’s emergency rules. Instead, the Court found that the ORIGINAL state statutes giving the DOH its emergency authority were themselves completely invalid, for four separate reasons, because the statutes:
- 1) violate constitutional separation of powers;
- 2) violate the state’s administrative procedure act;
- 3) are inconsistent with other public health laws; and
- 4) violate constitutional equal protection.
Relying on cited cases, the Judge listed all the ways that the state’s public health statutes violated separation of powers:

As a result, he ruled, those orders must be lifted, meaning that local health orders must be rescinded. "This case is about whether Missouri's Department of Health and Senior Services regulations can abolish representative government in the creation of public health laws, and whether it can authorize closure of a school or assembly based on the unfettered opinion of an unelected official. These service members, which include those with natural immunity to COVID-19, women who wish to become pregnant, or who have medical conditions for which no clinical trial data is available, face severe punishment, including dishonorable discharge, the loss of their constitutional rights, and potential imprisonment if they do not get these experimental vaccines that they have every right to refuse. ... The core claims raised in the lawsuit ask the court to bar the FDA and DOD from using deceptive “bait and switch” tactics and to uphold the constitutional right of every citizen to refuse an unwanted, unnecessary and unproven vaccine. The “bait and switch” involves the FDA’s approval of the Comirnaty vaccine, which is not available, while the FDA and DOD instead seek to administer the experimental, unapproved version of the vaccine (which cannot be mandated) to trick service members to forfeit their rights to informed consent and to refuse an experimental vaccine. ... This lawsuit also challenges the FDA’s unlawful “approval” of the Comirnaty Vaccine. This approval violated the Administrative Procedure Act, contradicted the FDA’s own rules, was based on flawed and incomplete scientific studies, and was made despite unprecedented numbers of adverse events – including deaths – related to the vaccine. The FDA also acted in an arbitrary and capricious manner, in that it excluded certain groups from clinical trials, including those with previous COVID-19 infection and pregnant women.

June 18, 2021. ICAN FILED PETITION TO THE FDA DEMANDING MORE DATA BEFORE ANY LICENSURE OF COVID VACCINE.
ICAN’s most recently filed Citizen Petition to the FDA is, perhaps, the most important one filed to-date. Approaching what appears to be the imminent licensure of Pfizer’s COVID-19 vaccine, ICAN’s legal team submitted a Citizen Petition demanding essential and specific data be required by the FDA before it licenses a vaccine for COVID-19. These requested data are vital to ensuring both safety and efficacy of the vaccine before any approval by the FDA.
Despite valid safety and efficacy concerns, COVID-19 vaccines have been and likely will continue to be mandated indiscriminately for groups that, for different reasons, have essentially zero or close to zero risk of serious complications from COVID-19.
Because of the compelling need to ensure the safety and efficacy of any COVID-19 vaccine approved by the FDA, including whether or not the risks do not outweigh the benefits, particularly in certain age categories, and in the face of such indiscriminate mandates, ICAN has requested that the FDA require that the following data be submitted to the FDA for review before approving any vaccine for COVID-19:
- Documentation of adverse events and reactions for at least twenty-four months for adults, thirty-six months for children and sixty months for infants and toddlers, or such longer duration as appropriate, and in no event ending prior to the subject reaching eight years of age;
- Data demonstrating that safety risks do not outweigh potential benefits for any age for which the vaccine is approved;
- Data reflecting that the vaccine does not cause DNA integration and germline transmission;
- Data on the safety and efficacy of the vaccine in individuals who currently have or have had a SARS-CoV-2 infection;
- Results of reproductive testing including proper immunological studies looking at potential reactivity of the vaccinated against the Syncytin 1 and 2 proteins;
- PCR tests used to qualify an event of COVID-19 for a trials’ endpoint use a maximum of 28 amplification cycles; and
- Accurate data reflecting actual risk reduction and number needed to vaccinate to prevent one case of COVID-19.

Forty three named and unnamed plaintiffs led by America’s Frontline Doctors have sued Secretary of the U.S. Department of Health and Human Services (DHHS) Xavier Becerra, both personally and in his official capacity, Director of the National Institute of Allergies and Infectious Diseases (NIAID) Dr. Anthony Fauci, both personally and in his official capacity, Acting Commissioner of the Food and Drug Administration (FDA) Dr. Janet Woodcock, both personally and in her official capacity, DHHS itself, FDA itself, the Center for Disease Control and Prevention (CDC), National Institute of Health (NIH), NIAID itself, and John and Jane Does I-V.
The theory of the case is that the EUAs were “the keys that unlocked the profit potential of the COVID-19 crisis,” enabling vaccine manufacturers to “reap billions of dollars in profit by exploiting the fears of the American people.” The complaint further alleges that the vaccines “have the potential to cause substantially greater harm than the SARS-CoV-2 virus and the COVID-19 disease” themselves.
Defendants are seeking civil money damages from Secretary Becarra, Dr. Fauci, and Dr. Woodcock personally.
The Complaint alleges that the Emergency Use Authorizations (EUAs) under which various “unapproved, inadequately tested, experimental, and dangerous” COVID-19 vaccines have been sold and administered are unlawful on multiple grounds and must be terminated immediately. The multiple grounds supporting termination of the EUAs, and by extension, administration of all COVID-19 vaccines, follows.

First, the Complaint alleges that the Emergency Declaration upon which the EUAs are all based was unjustified. Second, that the DHHS Secretary has failed to satisfy the “criteria for issuance” of the EUAs set forth in Section 546 of the Food, Drugs and Cosmetics Act 21 U.S.C. § 360bbb-3(c). Third, that the DHHS Secretary has failed to satisfy the “conditions of authorization” mandated by § 360bbb-3(e)(1)(A). If the District Court finds any of these grounds to be legally sustainable, the EUAs must as a matter of law be terminated.

America's Frontline Doctors files motion for temporary restraining order against use of COVID vaccine in children. May 20, 2021.
America's Frontline Doctors (AFLDS) today filed a motion in the U.S. District Court for the Northern District of Alabama requesting a temporary restraining order against the emergency use authorization (EUA) permitting using the COVID-19 vaccines in children under the age of 16, and that no further expansion of the EUAs to children under the age of 16 be granted prior to the resolution of these issues at trial.
The case will challenge the EUAs for the injections on several counts, based on the law and scientific evidence that the EUAs should never have been granted, the EUAs should be revoked immediately, the injections are dangerous biological agents that have the potential to cause substantially greater harm than the COVID-19 disease itself, and that numerous laws have been broken in the process of granting these EUAs and foisting these injections on the American people.
AFLDS Founder Dr. Simone Gold spoke about the reasons for filing the motion: "We doctors are pro-vaccine, but this is not a vaccine," she said. "This is an experimental biological agent whose harms are well-documented (although suppressed and censored) and growing rapidly, and we will not support using America’s children as guinea pigs."
She continued: "We insist that the EUA not be relinquished prematurely; certainly not before trials are complete - October 31, 2022 for Moderna and April 27, 2023 for Pfizer. We are shocked at the mere discussion of this, and will not be silent while Americans are used as guinea pigs for a virus with survivability of 99.8% globally and 99.97% under age 70.

Starting on May 5, Utah Legislature's House Bill 308, similar to the legislation in Arkansas and Montana, will prohibit "a government entity from directly or indirectly requiring an individual to receive a COVID-19 vaccine authorized for emergency use as a condition of employment or attendance at events that are hosted or sponsored by a government entity," according to the NCSL. Utah House Bill 308 prohibits governmental entities from requiring an individual to receive a COVID-19 vaccine. A governmental entity includes: (i) an executive agency, (ii) the legislative branch, (iii) the judicial branch, (iv) the State Board of Education, (v) the Utah Board of Higher Education, (vi) institutions of higher education and (vii) political subdivisions of the state (including school districts). Such entities may not make receipt of the vaccine a condition of employment, participation in activities or attendance at events that are hosted or sponsored by the entity. This prohibition does not apply to an employee who works in a public health or medical setting and are required to receive vaccinations in order to perform their assigned duties and responsibilities. The Bill was signed into law on March 16, 2021.
